This Privacy Notice informs as to how we handle your Personal Data when you visit our websites (regardless of your location), outline your privacy rights, and describe how the law protects you.
This Privacy Notice governs the control and processing by Repair Care [US], a Delaware [limited liability company] (“Repair Care”, “we”, “our”), of Personal Data (as defined below) from individuals including our customers, users of our website www.repair-care.com (“Website”) and its subdomains, users of our app and those we interact with offline and in person. For the purpose of this Privacy Notice, Personal Data may also be synonymous with the term “Personal Information,” depending on the jurisdiction in which you are located. Personal Data does not include data where the identity has been aggregated or de-identified as described below. If you are a resident of certain states, the corresponding state data protection laws and regulations grant you certain rights regarding your Personal Data. Purpose of this Privacy Notice
This Privacy Notice describes the ways in which Repair Care collects and processes your Personal Data, including through your use of our Websites when you interact with us, purchase a product or service on or offline, or take part in a competition.
Our Websites are not intended for children and we do not knowingly collect data relating to children.
Please read this Privacy Notice carefully to understand our policies and practices regarding your Personal Data and how we will treat it. If you do not agree with our practices, your choice is to not use our Website. By Accessing or using our Website, you agree to this Privacy Notice.
Changes to the Privacy Notice and Your Duty to Inform Us of Changes
We may amend this Privacy Notice at any time. In case this Privacy Notice is amended, we will make the amended Privacy Notice available to you on our Website. We will notify you of any material amendments to the Privacy Notice. Please review this Privacy Notice whenever you visit the Website, purchase a product, or when prompted when we collect Personal Data from you offline to check if there have been any changes, so that you know the terms that apply to you at that time. At the top of this Privacy Notice, you can see when this Privacy Notice has been updated. Continued use of the Website following such changes constitutes the acceptance of those changes.

As outlined above, we may collect, use, store and transfer different kinds of Personal Data about you which we have grouped together follows:
- Identity Data includes first name, last name and job description.
- Contact Data includes billing address, delivery address, email address and telephone numbers.
- Transaction Data includes details about payments to and from you and other details of products and services you have purchased from us.
- Technical Data includes internet protocol (IP) address if it can personally identify you, including when aggregated with your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access our websites.
- Profile Data includes your username and password, purchases or orders made by you, your interests, preferences, feedback and survey responses.
- Usage Data includes information about how you use our websites, products and services.
- Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.
We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. “Aggregated Data” is information that relates to a group or category of individuals, from which individual identities have been removed, that is not linked or reasonably linkable to any individual, including via a device.. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your Personal Data so that it can directly or indirectly identify you, we treat the combined data as Personal Data which will be used in accordance with this privacy notice.
We may also de-identify your data. “De-identified Data” is information that cannot reasonably be used to infer information about, or otherwise be linked to, a particular individual provided that the we: (1) take reasonable measures to ensure that the information cannot be associated with an individual; (2) publicly commit to maintain and use the information in de-identified form and not to attempt to reidentify the information, except that we may attempt to reidentify the information solely for the purpose of determining whether our de-identification processes satisfy the requirements of this Privacy Notice; and (3) contractually obligate any recipients of your data to comply with all provisions of this Privacy Notice.
In the event that your data becomes Aggregated or De-identified, it is no longer deemed Personal Data, except as outlined above.
We do not collect any Sensitive Personal Data about you. Depending on your jurisdiction, sensitive Personal Data can include your race or ethnicity, national origin, citizenship or immigration status, religious or philosophical beliefs, sex life, sexual orientation, status as transgender or nonbinary, political opinions, trade union membership, information about your mental or physical health, and genetic and biometric data, criminal convictions and offences.
IF YOU FAIL TO PROVIDE PERSONAL DATA
Where we need to collect Personal Data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.
- HOW IS YOUR PERSONAL DATA COLLECTED?
We use different methods to collect data from and about you including through:
- Direct interactions – You may give us your Identity, Contact and Financial Data by filling in forms or by corresponding with us by website, mail, phone, email or otherwise. This includes Personal Data you provide when you:
- purchase or apply for our products or services;
- create an account on our websites;
- subscribe to our service or publications;
- request marketing to be sent to you;
- participate in a competition, promotion or survey; or
- provide us with feedback.
- Automated technologies or interactions. As you interact with our Websites, we may automatically collect Technical Data about your IP address, Website usage, and browser settings, actions and patterns. We collect this Personal Data by using cookies, and other similar technologies. We may also receive Technical Data about you if you visit other websites employing our cookies. - Direct interactions – You may give us your Identity, Contact and Financial Data by filling in forms or by corresponding with us by website, mail, phone, email or otherwise. This includes Personal Data you provide when you:

- analytics providers such as Google based outside the EU;
- search information providers such as Google Analytics.
- Contact, Financial and Transaction Data from providers of technical, payment and delivery services such as PayPal and financial institutions.

- HOW WE USE YOUR PERSONAL DATA
We will only use your Personal Data when the law allows us to. Table 1 (above) describes the ways in which we use your Personal Data, and the legal basis for each. We have also identified what our legitimate interests are where appropriate. Note that we may process your Personal Data for more than one lawful ground depending on the specific purpose for which we are using your data. Please contact us if you need details about the specific legal ground on which we rely.
Most commonly, we will use your Personal Data where:
- We need to perform the contract we are about to enter into or have entered into with you;
- It is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests. Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your Personal Data for our legitimate interests. We do not use your Personal Data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). Generally we do not rely on consent as a legal basis for processing your Personal Data other than in relation to sending third party direct marketing communications to you via email. You have the right to withdraw consent to marketing at any time by contacting us.
Marketing
We strive to provide you with choices regarding certain Personal Data uses, particularly around marketing and advertising and, in particular, we will always offer an ‘opt out’.
Promotional Offers from Us
We may use your Identity, Contact, Technical, Usage and Profile Data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you (we call this marketing).
You will receive marketing communications from us if you have requested information from us, purchased goods or services from us, or if you provided us with your details when you entered a competition or registered for a promotion and, in each case, have not opted out of receiving that marketing.
Third Parties To Whom We May Disclose Personal Data
Service providers: We may disclose your Personal Data with external service providers that provide services to enable your use of the Website or our Services and the fulfillment of the obligations of our contract. These service providers are bound by our instructions and are regularly checked and may include Google analytics, Facebook, Instagram, Linkedin, Salesforce among others. We have entered into and maintain agreements (e.g., data processing agreements) with our service providers to whom we disclose Personal Data and who process Personal Data on our behalf.
- Other companies in the Repair Care group: We may disclose your Personal Data to companies within the Repair Care group to the extent necessary for us to fulfill the purposes mentioned under Section;
- Counterparties in a corporate transaction: We may disclose your Personal Data to a potential buyer during negotiation of, in connection with, a corporate transaction where your Personal Data is included as an asset (e.g., a merger, acquisition, joint venture, or financing or asset sale). Your Personal Data may also be disclosed in the event of insolvency, bankruptcy, or receivership; and
- Government authorities, law enforcement representatives: We may disclose your Personal Data with third parties, such as legal advisors and law enforcement representatives to comply with court orders, enforcement actions, and applicable laws, rules, and regulations.
Cross-context Behavioral/Targeted/Interest-based Advertising.
Cross-context behavioral advertising means sending you targeted advertising based on information (which may include Personal Data) obtained from your activity across businesses, websites, applications, or services with which you intentionally interacted. We may use third-party advertising companies to serve you targeted advertising based on your Personal Data as well as Aggregated and De-identified Data collected when you visited our Website (e.g., browsing history). We may disclose to, or permit, such third-party advertising companies to collect information about your use of our Website or our Services to enable them to display advertising on our behalf.
Opting Out

Where you opt out of receiving these marketing messages, this will not apply to Personal Data provided to us as a result of a product/service purchase, product/service experience or other transactions.
Cookies
You can set your browser to refuse all or some browser cookies, or to alert you when websites set or access cookies. If you disable or refuse cookies, please note that some parts of the relevant Website may become inaccessible or not function properly. Change of Purpose
We will only use your Personal Data for the purposes for which it was collected unless we reasonably consider that we need to use it for another reason that is compatible with the original purpose. If you wish to get an explanation or obtain more information, please contact us.
If we need to use your Personal Data for a new purpose, we will notify you and we will explain the legal basis which allows us to do so.
Please note that we may process your Personal Data without your knowledge or consent, in compliance with the above rules to the extent required or permitted by law.
- DATA SECURITY
We use commercially reasonable efforts to secure the processing of your Personal Data, by maintaining reasonable administrative, technical, and physical controls which are designed to protect your Personal Data against loss or theft, as well as against any unauthorized access, risk of loss, disclosure, copying, misuse, or modification.
Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Data, we cannot guarantee the security of your Personal Data while in transit to our Website. Any transmission of Personal Data is at your own risk. The safety and security of your Personal Data also depend on your efforts (e.g., securing your password, transmitting your Personal Data over a secure network, etc.).
In case any breach of the security of our system occurs in which your Personal Data was, or is reasonably believed to have been, acquired by an unauthorized person, we will notify you of such breach as soon as reasonably possible, but not before law enforcement agencies have determined that the notification has not impeded a criminal investigation, by written notification.
- DATA RETENTION
What Is Our Retention Policy?
Personal Data are retained for various lengths of time depending on what is reasonably necessary for us to fulfill the purpose for which it was collected. Applicable laws, rules, or regulations may require that we retain it for a longer period of time.
How long we keep Personal Data can vary widely depending on the context of the services we offer. We use the following criteria to determine the retention period: the nature of the Personal Data; the context in which the Personal Data have been collected; the consequences for you and the existing safeguards.
For example, if you sign up for the newsletter, or if you submit a request or question using the contact form on the Website, we will keep your Personal Data for as long as necessary to address your request or respond to your question.
In some circumstances your Personal Data may become Aggregated or De-identified so that it can no longer be associated with you as described in Section 2 of this Privacy Notice. The Aggregated or De-identified Data may be used by us for research or statistical purposes indefinitely without further notice to you.
- YOUR LEGAL RIGHTS
Below is a list of requests that you can submit to us in connection with your Personal Data. Please refer to our State Specific Notice [link] for additional rights that residents of certain states may exercise.
Every user of our Website and Services may request (i) information on the Personal Data we collect from them, (ii) access to an overview of such Personal Data, (iii) correct or delete their Personal Data, and (iv) to receive the requested information on your Personal Data in a portable manner. We will respond to your request related to Personal Data only if we can verify your identity or your authority to make the request, and if we can confirm that the Personal Data relates to you or the person on whose behalf you are submitting the request.
You do not need to create an account with us to submit a request related to Personal Data, however, you may have to use your existing account to submit a request.
Please be informed that if you make certain requests (e.g., request to delete Personal Data), we may no longer be able to offer you the use of the Website or portions thereof (e.g., access to your Repair Care account may be limited). You may also lose access to the Personal Data in your Repair Care account. We are not under any obligation to maintain a back-up of Personal Data.
Except as noted above, please also be aware that should you exercise your rights regarding your Personal Data, we will not discriminate against you in any way, including, but not limited to: denying you goods or services; offering you less favorable prices or terms and conditions of your transactions with us; or providing you with a different level quality of goods or services. We may, however, provide a different level of goods or services if such difference is reasonably related to the value provided to us by your Personal Data.
What Is Our Response Time and Format?
We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact us at supportus@repair-care.com.
We endeavor to respond to the substance of your verified request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.
If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.
Any disclosures we provide will only cover the 12-month period preceding receipt of your request. Upon your request, unless it is impossible or involves disproportionate effort, we will also provide you with disclosures beyond the 12-month period for Personal Data. If we cannot comply with your request, the response we provide will also explain the reasons why. We will provide your Personal Data in a format that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
You may only submit a request to know once within a 12-month period unless the applicable section in the State-Specific Notice states otherwise.
We do not charge a fee to process or respond to your verifiable request unless your request is without basis or excessive, in particular if we have received repeated similar requests from you. If we determine that the request warrants charging a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Right to Know. You have the right to request that we disclose certain information to you about our collection and use of your Personal Information. Once we receive your request and confirm your identity, we will disclose to you:
- The categories of Personal Information we collected about you;
- The categories of sources from which we collected Personal Information about you;
- Our business or commercial purpose for collecting, disclosing, “selling” or “sharing” such Personal Information;
- The categories of Personal Information we disclosed about you for a business purpose and the categories of third parties to whom such Personal Information was disclosed for a business purpose;
- The categories of Personal Information that we “sold” or “shared” about you;
- The categories of third parties to whom your Personal Information was “sold” or “shared” and we will make such disclosure for each category of such Personal Information; and
- The specific pieces of Personal Information we collected about you.
Right to Correct. You have the right to request that we correct your Personal Information if you think it is inaccurate, taking into account the nature of the Personal Information and the purposes of the processing of the Personal Information. Once we receive your request and confirm your identity, we will use commercially reasonable efforts to correct your inaccurate Personal Information and will direct our service providers to do the same.
Right to Delete. You have the right to request that we delete any of your Personal Information that we have collected from you and retained, subject to certain exceptions. Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the Personal Information applies.
We may deny your deletion request if retaining the Personal Information is necessary for us or our service provider(s) to:
- Complete the transaction for which we collected the Personal Information, fulfill the terms of a written warranty, provide a good or service that you requested or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;
- Help to ensure security and integrity to the extent the use of your Personal Information is reasonably necessary and proportionate for those purposes;
- Debug to identify and repair errors that impair existing intended functionality;
- Exercise free speech, ensure the right of another individual to exercise their right of free speech, or exercise another right provided for by law;
- Comply with the California Electronic Communications Privacy Act pursuant to Chapter 3.6 of Title 12 of Part 2 of the Penal Code (Cal. Penal Code § 1546 et. seq.);
- Engage in public or peer-reviewed scientific, historical, or statistical research that adheres to all other applicable ethics and privacy laws, when our deletion of the Personal Information is likely to render impossible or seriously impair the ability to complete such research, if you previously provided informed consent;
- Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us and compatible with the context in which you provided the information; and/or
- Comply with a legal obligation.
We will delete or de-identify Personal Information not subject to one of these exceptions from our records and will direct our service providers, contractors and third parties to whom we have “sold” or “shared” your Personal Information to take similar action, unless this proves impossible or involves disproportionate effort. However, we may maintain a confidential record of your deletion request to prevent the “sale” of your Personal Information; to comply with applicable laws; and for other purposes permissible under California Law.
Right to Opt Out of Certain Processing for Sensitive Information. California Law provides its residents with a right to limit the use and disclosure of Sensitive Personal Information.
Right to Data Portability. You have the right to obtain a copy of the Personal Information that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit your Personal Information to another controller without hindrance, where the processing is carried out by automated means.
Right to Opt Out of Sales. You have the right to direct us to stop “selling” (i.e., disclosing your Personal Information to third parties for monetary or other valuable consideration) or “sharing” your Personal Information (i.e., disclosing your Personal Information to third parties for cross-contextual behavioral advertising).
Once we receive your request and confirm your identity, we will stop “selling” or “sharing” your Personal Information, unless you subsequently provide consent for the “sale” or “sharing” of your Personal Information.
Other California Privacy Rights. California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Website who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. You may only make one such request during the course of a calendar year. We do not disclose any Personal Information to third parties for their direct marketing purposes without your approval. We “share” Personal Information within the Repair Care Group for marketing purposes.
- Exercising your Rights under California Law
Section 7 of this Privacy Notice will provide you with information on how to exercise your rights. Under California law, we are required to make additional disclosures:
- To exercise your rights to opt out of “sale” or “sharing,” please submit a request by using the following link that you can also find on our website entitled “Do Not Sell or Share My Personal Information”.
- We do not use or disclose your sensitive personal information for any other purpose other than to perform business services, including providing our products and services to you.
Only you, or someone legally authorized to act on your behalf, may make a request related to your Personal Information. You may also make a request on behalf of your minor child.
Your request related to Personal Information must:
- Provide sufficient information or documentation that allows us to reasonably verify whether you are the person about whom we collected Personal Information or an authorized representative. Such information or documentation may include:
- Certain Personal Information about you that we have on file (g., postal address) or information related to the purchases you made on the Website.
- Certain information or certification showing your authority or relationship to the person on whose behalf you are submitting the request.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We will only use Personal Information provided in the request to verify the requestor’s identity or authority to make it. Other than under the Shine the Light law, you may make two such requests during the course of a calendar year.
- Response Timing and Format
Please review Section 7 of our Privacy Notice for our response time. For requests under California’s Shine the Light Law, we will respond within thirty (30) days of receipt of your request.
- Appealing Privacy Rights Decision
You may be able to appeal a decision we have made in connection with your privacy rights request. All appeal requests should be submitted via email to supportus@repair-care.com.
